NOTICE OF ADOPTION

Notice is hereby given that the Township Board for Lyndon Township, Washtenaw County, Michigan adopted amendments to the Private Road Ordinance at a regular meeting held on November 10, 2020.

Summary of the amendments are below. Underlined words where added and Strikeout word were removed.

SECTION V.  GENERAL REQUIREMENTS

– Item 1 revision to the existing wording as shown below:

“All lots must  that abut a public road or private road must do so for an uninterrupted distance equal to the minimum lot width specified for the district in which it is located.”

-Item 2, addition of this item shown below:

Lots that do not abut a public road or private road and are to be accessed by way of an exclusive access easement or shared residential driveway must meet all applicable standards of this Ordinance.”

SECTION IX.  EXECLUSIVE ACCESS EASEMENT FOR ONE SINGLE FAMILY RESIDENCE

-Item 2 addition of this item shown below:

“Parcels fronting on a public road or private street must be accessed by way of that public road or private street.  They may not obtain an exclusive access easement from another parcel.”

-Item 3 (b) addition of this sub item shown below:

“An access easement may only  be granted allowing access to a public street or private road.  It may not be granted allowing access to a shared residential driveway.”

(c) revision to the existing wording shown below:

“Since the An Exclusive Access Easement shall serve only one single family residence, therefore, no specific width or thickness standards of the road are required. However, those providing this type of access must conform to the intent of the Ordinance with their proposed construction and must provide assured safe and continuous access for the residents, police, fire, and other emergency vehicles.”

SECTION X.  SHARED RESIDENTIAL DRIVEWAYS

-Item 2 (a)addition of this sub item shown below:

No parcel or lot may contain more than one shared residential driveway.”

The above mentioned revisions and additions to the regulations in the Private Road Ordinance are intended to comply with the regulations in the Zoning Ordinance, Section 3.04 Street Access and the regulations of the Land Division and Transfer Ordinance. These regulations will allow one or two divisions to properties that are either access with an exclusive easement or a shared driveway without requiring frontage on a private or public street as long as all other regulations can be met.

A copy of the full text of the amended Private Road Ordinance may be inspected or purchased at the Township Offices (17751 N. Territorial Road, Chelsea, MI 48118). The new Private Road Amendments will also be posted on the Township’s website at

https://lyndontownshipmi.gov/news/. The adopted amendments shall become effective thirty (30) days after the notice is published.
